The petitioner has prayed for bail in a case registered for the offence punishable under sections 399, 402, 412, 413, 414 of the Indian Penal Code and sections 25(1-B)A, 26 and 35 of the Arms Act.

Prosecution case relates to recovery of one country made pistol, two live cartridge and two mobiles were recovered from the possession of the petitioner. Prior to recovery, the said arms were used in bank dacoity.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. Petitioner has come to the shop to purchase cigaratte and breakfast materials of rest of his associates who are staying at

Patna High Court CR. MISC. No.33592 of 2023(2) dt.24-06-2023 2/2 the house of co-accused Ashok Ram and from there possession, arms were recovered, and the same is said to be recovered from the possession of the petitioner. Petitioner is languishing in judicial custody since 8.12.2022.

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran in connection with Yogapatti P.S. Case No. 676 of 2022.
