Petitioner is apprehending arrest in connection with Nawada Town (Bundelkhand) PS Case No. 453/2018 for the offence under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel appearing for the petitioner submits that the petitioner has no criminal antecedent. He submits that the criminal case was registered at the instance of the Inspector of Police of Bundelkhand Police Station. Learned counsel further submits that the person arrested with 11 bottles of liquor disclosed the name of the petitioner. It is submitted that the petitioner is the owner of the vehicle. He runs a crockery shop and he has no connection with liquor business and nothing was recovered from the physical possession of the petitioner. The
Patna High Court Cr.Misc. No.71190 of 2018(2) dt.17-12-2018 2/2 offence was committed by one Vikash Kumar who has been released on bail.
Considering the totality of the fact situation, this application is allowed. Accordingly, in the event of arrest or surrender before the court below within a period of one month from today, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Addl. Sessions Judge-cum-Special Judge (Excise),Nawada in connection with Nawada Town (Bundelkhand) PS Case No. 453/2018 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
