The petitioner seeks bail in connection with Marauna P.S. Case No. 28 of 2019 instituted for the offence under Section(s) 30(A) of Bihar Prohibition & Excise Act, 2016. Learned counsel for petitioner is permitted to make necessary correction in the bail petition during course of day. Learned counsel for petitioner has submitted that there is no recovery of any illicit liquor from conscious possession of this petitioner.
From seizure list, which is part of the FIR, it appears that recovery has been made from the ditch near Railway Track. In the written report it is alleged that police got information that petitioner had kept alcohol in a ditch to sale
Patna High Court CR. MISC. No.31496 of 2019(2) dt.01-07-2019 2/2 on occasion of Holy. The police conducted raid and recovered illicit liquor . The petitioner was not present on the spot. The name of petitioner was disclosed by Choukidar. Petitioner is in custody since 19.3.2019.
Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II Supaul, in connection with Marauna Case No. 28 of 2019 , S.T. (Excise) no. 198 of 2019 subject to the condition that both the bailors shall be the close relative of the petitioner.
