JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 19-02-2021 Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P. for the State. The petitioner seeks bail in connection with Mashrakh P.S. Case No. 95 of 2018 registered for the offences punishable under Sections 302, 120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

By order dated 08.08.2019, the bail application of the petitioner has been rejected with observation that the trial court is directed to expedite the trial and make efforts to conclude the same as early as possible preferably within a period of nine months.

Status report was called for, which shows that one of the co-accsued has filed the discharge petition in the present

Patna High Court CR. MISC. No.35129 of 2020(4) dt.19-02-2021 2/2 case, therefore, the charge has not been framed against the petitioner and other co-accused.

Learned A.P.P. for the State opposed the bail petition. In the facts and circumstances of the case, I am not inclined to enlarge the above named petitioner on bail. Accordingly, the prayer for bail in connection with Mashrakh P.S. Case No.95 of 2018 pending in the court of learned A.C.J.M. VIth, Saran at Chapra is hereby rejected at present.
