Counter affidavit has been filed by learned APP for the State, which is kept on record.

Petitioners apprehend their arrest in Bhagwanpur (Belaon) P.S. Case No.17 of 2020, registered for the offences punishable under Sections 353, 420, 409 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in the present case. It is submitted by filing supplementary affidavit that one Chandrama Dixit who is father-in-law of petitioner no.1 has asked for report

Patna High Court CR. MISC. No.33474 of 2020(8) dt.13-12-2021 2/3 as to whether work of Nal-Jal Scheme has been completed in Ward No.8 of Akhodhi Panchayat or not. Thereafter the Public Information Officer-cum-District Panchayat Raj Officer has issued a letter to Public Information Officer-cum-Block Development Officer, Rampur to give report as to the application given through Right to Information. It is submitted that thereafter the Block Development Officer, Rampur has forwarded the aforesaid letter to the Panchayat Secretary, Belaon, vide Memo No.1121, dated 26.06.2021 to provide information as to the application of Chandrama Dixit. Thereafter Chandrama Dixit obtained information vide letter no.33, dated 02.07.2021 issued by Panchayat Secretary, Belaon wherein it has been reported that work of Nal-Jal Scheme of Ward No.

8 has been completed. It is further submitted that the State has supported the aforesaid fact in their counter affidavit. Having considered the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-2, Kaimur at Bhabua in connection with Bhagwanpur (Belaon) P.S.
