JUSTICE VIKASH JAIN ORAL ORDER 25-08-2018 The present writ petition has been filed for setting aside the order contained in memo no. 1639 dt. 31.12.2014 issued by the District Agriculture Officer, Katihar, by which the retail fertilizer license of the petitioner being license no. 15 of 20132014 has been suspended and further the petitioner was directed to file show cause within a week of the receipt of the notice failing which, the license of the petitioner will be cancelled.

2. Learned counsel for the petitioner submits that the validity of the suspension order stood automatically revoked as no further action was taken within the statutory period of 15 days in terms of clause 31(ii) of Fertilizer Control Order, 1985.

3. Having regard to the nature of the grievance of the petitioner, the writ petition stands disposed of with a liberty to the

Patna High Court CWJC No.12990 of 2015 (3) dt.25-08-2018 2/2 petitioner to approach the District Agriculture Officer, Katihar (respondent no. 2) with an appropriate representation for redressal of his grievance. If any such representation is filed within a period of four weeks from today, the same shall be considered and disposed of after grant of opportunity of hearing to the petitioner in accordance with law expeditiously and in any event within a period of eight weeks thereof.
