The petitioner is apprehending his arrest in connection with Chanpatiya P.S. Case No.50 of 2018 for the offence under Sections 25(1-b)a/26/35 of the Arms Act.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The name of the petitioner surfaced on the confessional statement of co-accused Rakesh Kumar who was arrested in the instant case. The said Rakesh Kumar disclosed the name of Pankaj Chaudhary, Sikandar Kumar, Afzal Saheb and Sonelal Kumar. Learned counsel for the petitioner further submits that Sonelal Kumar whose name was disclosed by the said Rakesh Kumar was granted

Patna High Court Cr.Misc. No.75061 of 2018(2) dt.18-12-2018 2/2 anticipatory bail by co-ordinate Bench of this Court in Crl. Misc. No. 17670 of 2018 vide order dated 05.04.2018. Considering the totality of the fact situation including the fact that the petitioner has no criminal antecedent and similarly circumstanced other co-accused Sonelal Kumar has been granted anticipatory bail by Co-ordinate Bench of this Court, let the petitioner above named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Chanpatiya P.S. Case No. 50 of 2018, subject to the conditions as laid down under Section 438 Cr.P.C. (Anil Kumar Upadhyay, J) T.Kr./- U T
