The petitioner apprehends his arrest in connection with Bakhtiyarpur P.S. Case no. 499 of 2018, registered under Sections 147, 148, 149, 341, 323, 307, 427, 353 and 283 of the Indian Penal Code and Section 27 of the Arms Act. The accusation is that Police apprehended two drunken persons, thereafter, 150 to 200 persons of the locality assembled there and started brick-batting on the Police personnel in order to get release the apprehended two persons. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R., rather, his name surfaced in course of investigation. Patna High Court CR. MISC. No.33576 of 2019(2) dt.22-05-2019 2/2 granted privilege of pre-arrest bail by a co-ordinate Bench of this Court on 28.01.2019 vide Criminal Miscellaneous No. 846 of 2019. The petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Addl. Chief Judicial Magistrate-I, Barh, Patna in connection with Bakhtiyarpur P.S. Case No. 499 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
