The petitioner apprehends his arrest in Bheja P.S. Case No.29 of 2020, registered for the offences punishable under Sections 341, 323 and 354(B) of the Indian Penal Code. The petitioner is said to have tried to commit rape upon the informant. The petitioner is also said to have tried to outrage the modesty of the informant.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in the present case. It is further submitted that there is previous enmity between the parties, therefore, the present case has been filed by the informant (Annexures 2 and 3). It is lastly submitted that the petitioner has got two criminal antecedents as stated in

Patna High Court CR. MISC. No.42406 of 2021(2) dt.11-04-2022 2/2 paragraph 3 of the bail application.

Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Having considered the fact that there is previous enmity between the parties, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be released on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M., IIIrd, Jhanjharpur, District Madhubani in connection with Bheja P.S. Case No.29 of 2020, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
