Petitioner seeks regular bail in a case registered for the offence punishable under Section 341, 323, 354(B), 427, 324, 504, 506, 34 of the Indian Penal Code and u/s 12 of POCSO Act.
As per the prosecution case, petitioner is alleged to have tried to outrage the modesty of the victim. It is further alleged that when father-in-law of informant went at the house of petitioner to enquire about the occurrence, this petitioner along with other accused persons are alleged to have abused and assaulted him and threatened him.
Learned counsel appearing for the petitioner submits that petitioner is innocent and has falsely been implicated in the case. It is submitted that occurrence is said to have taken place
Patna High Court CR. MISC. No.42241 of 2021(2) dt.28-10-2021 2/2 on 01.11.2020 but the FIR was lodged on 06.11.2020 without any explanation. It is submitted that victim of this case was cutting crop from the field of this petitioner for which mother of this petitioner filed Complaint case No. 459/2020 against the informant of this case and others and the informant just to pressurize the petitioner and his family members lodged this false case. Petitioner claims clean antecedent and is in custody since 30.04.2021 and investigation in this case is complete. Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case and the period of custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VI-cum- Special Judge, POCSO Act, Madhubani in connection with Ladaniya PS case No. 225/2020.
