2. Learned counsel for the petitioner submits that though earlier prayer for bail of the petitioner was rejected by order dated 09-07-2024 passed in Cr. Misc. No. 21346 of 2024 but the petitioner is renewing his prayer on the ground of prolonged incarceration i.e. near about two years. The victim, in her statement recorded under Section-164 of the Cr.P.C., has stated that she followed the petitioner to Maharashtra where he kept her for two and a half months and also committed rape upon her.

3. From perusal of impugned order, it appears that

4. Learned APP has opposed the prayer for bail.

6. Considering the aforesaid facts as well as the medical report, according to which, the age of the victim is 1719 years and the period of custody, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-VI (Special Judge, POCSO), Saran, Chapra in connection with Garkha P.S. Case No. 277 of 2023.

7. The petitioner will appear in the court below on each and every date fixed in the case and if, he fails to do so on two consecutive dates unless he is prevented by extremely adverse circumstances, the learned court below shall be at liberty to cancel the bail bonds of the petitioner.
