2. Petitioner seeks regular bail in connection with Narpatganj P.S. Case No. 93 of 2024, dated 18.02.2024, corresponding to Spl. N.D.P.S. Case No. 43 of 2024, registered for the offence punishable under Sections 8(c) and 21(b) of the NDPS Act.

3. As per the prosecution story, on 17.02.2024, based on secret information, a S.S.B. patrolling party led by A.S.I. Shambhu Ram Senwar (informant) laid a trap in Bela Ward No.8, about 2 Kms inside Indian Territory, at about 5:05 p.m, the petitioner (Saroj Shrestha), a Nepalese national, was seen coming from India towards Nepal. When asked to stop, he attempted to flee but was

Patna High Court CR. MISC. No.31658 of 2025(3) dt.13-08-2025 2/2 apprehended. In the presence of Assistant Commandant and two official witnesses, his personal search was conducted. From the left pocket of his pants, a black plastic packet containing 10 grams of brown sugar (heroin) was recovered. The contraband along with the packaging weighed 12.52 grams in total.

The main submissions advanced by petitioner's counsel are that the instant matter relates to the recovery of ten grams of Brown Sugar from the possession of this petitioner, the petitioner bears no criminal antecedent and has been languishing in jail since 18.02.2024 in connection with a false case regarding the alleged recovery of contraband, prepared by the police with the help of S.S.B.

5. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.

Considering the trial court's report which shows that the petitioner's case is at the verge of end as it has been running for the defence evidence since 16.06.2025, so, in view of this fact, this Court is not inclined to release the petitioner on bail at this stage.
