====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 16-07-2019 Heard learned counsel for the petitioner, counsel for the informant and the State.

The petitioner seeks bail in Barh P.S. Case No. 25 of 2018, instituted for the offence under Section(s) 363 and 366/34 of the Indian Penal Code.

It is alleged in the written report that minor daughter of the informant had gone to School for participating in Human Chain. It is further alleged that when she along with her friend was returning to the house, petitioner who is her brother-in-law along with his other family members kidnapped her with Bolero Vehicle.

The victim girl has given statement under Section 164 Cr. P.C. wherein she has stated that she identified her Jija

Patna High Court CR. MISC. No.31815 of 2019(2) dt.16-07-2019 2/2 Pradeep Mahto (petitioner) in Bolero vehicle. She also identified Rita Devi, Sango Devi and Rekha Devi who were sitting in the vehicle. She went to the house of her Mausi by the vehicle. She has not levelled any allegation of committing illegal act against the petitioner in her statement recorded under Section 164 Cr. P.C.

Petitioner is in custody since 26.2.2019.

Counsel for the informant has appeared and opposed the prayer for bail.

Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-1st, Barh, Patna, in connection with Barh P.S.
