It is submitted by the learned counsel for the appellant that the appellant Om Prakash Verma who preferred the instant appeal has died during serving sentence of imprisonment of ten years and as per his information the appellant's legal heir or near relatives are not interested to keep the present appeal pending and they want to dispose of this appeal in the light of death of the appellant.

Having considered the above submission as well as considering the report of Court below received vide letter no. 130 dated 04.11.2022 which confirms the above-mentioned
