JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-12-2018 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Barun P. S. case no. 195/2018 registered under sections 379, 411, 420/34 of the IPC, section 4/40 of Bihar Mineral Rules and section 15 of the Environment Protection Act. Two tractors laden with sand were seized. Petitioner happens to be owner-cum- driver of one of the tractors. However, it is submitted that the petitioner had valid documents of seized sand.

Considering the aforesaid facts and circumstances as well as submissions of the parties, in the event of arrest/ surrender within four weeks from the date of receipt of this

No.73384 of 2018(2) dt.20-12-2018 2/2 order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in Barun P. S. case no. 195/2018 subject to condition as laid down under section 438(2) of the Cr.P.C.
