The petitioner is apprehending her arrest in a case registered for the offences punishable under Sections 147, 148, 341, 323, 307 of the Indian Penal Code. Later on, Section 302 I.P.C was also added. The prosecution case as per F.I.R is that while the husband of the informant was parking his vehicle, all the F.I.R named accused persons including the petitioner came with lathi, danda, etc and assaulted him, as a result of which, he sustained grievous injuries. When the informant and her daughter came to save the victim,
Patna High Court CR. MISC. No.42441 of 2021(3) dt.14-12-2022 2/3 they were also assaulted by the accused persons. The husband of the informant subsequently succumbed to the injuries during treatment.
It is submitted by learned counsel for the petitioner that petitioner is innocent and she has falsely been implicated in this case. Altogether 20 persons are named in the F.I.R. There is general and omnibus allegation against the petitioner. There is general and omnibus allegation against the petitioner. The petitioner is a lady and she does not have any criminal antecedent. A statement to that effect has been made in para 3 of the petition. Moreover, other similarly situated coaccused has been granted anticipatory bail by a coordinate Bench of this Court vide Cr. Misc. No. 23357 of 2021.
In the facts and circumstance of the case, let the petitioner, above named, in the event of her arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail

No.42441 of 2021(3) dt.14-12-2022 3/3 on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Hajipur in connection with Hajipur Town P.S. Case No. 397 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
