The petitioner seeks bail in a case registered for the offence punishable under Sections 25(1-b)a, 26, 35 Arms Act. The prosecution case is that one country made pistol and its magazine two live cartridges have been recovered from the possession. There is no sufficient evidence to prove the prosecution against the petitioner and the prosecution story is totally false implicated in this case due to dirty village politics and only to harass the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 27.02.2019 and said that witness of seizure list has filed an affidavit before the Court of

No.31375 of 2019(4) dt.05-07-2019 2/2 learned A.C.J.M. 4th, Buxar that nothing has been recovered from the possession of the petitioner and only due to pressure of police he has signed on plain paper before police. Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Simri P.S. Case No. 63/2019 to the satisfaction of the learned A.C.J.M.- 4th, Buxar.
