No. 1 of 2025 to implead Railway Authorities as necessary and proper party. It is to be noted that Railway Authorities are not party to CWJC No. 15026 of 2023 dated 05.04.2024. Therefore, appellant can not maintain I.A. No. 1 of 2025, insofar as impleading Railway Authorities as necessary and proper party, for the reasons that Railway Authorities have lost their right to agitate their right before the learned Single Judge in CWJC No.

2. That apart having regard to the fact that subject matter of shop is in the premises of Railway Authorities, they are necessary and proper party. In this backdrop, learned counsel for the appellant seeks permission to withdraw the present LPA.

3. Accordingly, LPA stands dismissed as withdrawn reserving liberty to the appellant to invoke remedy of civil review in CWJC No. 15026 of 2023 dated 05.04.2024.

4. Pending interlocutory application(s), if any, stands disposed of.
