The present writ petition has been filed for directing the respondent authorities to cancel the selection of private respondent no.5 on the post of Anganbari Sevika in Ward No.8, Village- Parnathpur, Gram Panchayat- Khusmaha, P.S. Amarpur, District- Banka and select the petitioner on the aforesaid post.
2. Learned Counsel for the State submits that the petitioner has challenged the appointment of respondent no.5 on the post of Anganwari Sevika. It is further submitted that he has
Patna High Court CWJC No.12500 of 2019(3) dt.24-09-2024 2/2 not challenged the appointment of the respondent no.5 before Original Authority and moved directly before this Court.
3. It transpires to this Court that remedy to the petitioner lies before the Original Authority under the relevant Margdarshika for the appointment of Anganwari Sevika and Sahayika which has not been exhausted yet by the petitioner.
4. In this view of the matter, the present writ petition stands disposed off granting liberty to the petitioner to avail the remedy before the Original Authority under the relevant Margdarshika for the appointment of Anganwari Sevika and Sahayika, if cause of action still survives.
