It is a serious case of robbery of government money, which was said to be snatched by two known persons The petitioner was arrested and put on test identification parade in which he was identified by the witnesses.
The contention on behalf of the petitioner is that one coaccused Arun Kumar Yadav was also identified in test identification parade but a co-ordinate Bench of this Court granted privilege of bail to him whereas petitioner is languishing in jail custody since 30.11.2013 Considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to grant privilege of bail to the petitioner, accordingly, his prayer for bail in
Patna High Court Cr.Misc. No.39373 of 2014 (4) dt.07-04-2015 2/2 connection with Lakhisarai P.S.Case No. 478 of 2013, pending in the court of Chief Judicial Magistrate, Lakhisarai stands rejected.
However, the learned trial court is directed to conclude the trial of the petitioner within six months from the date of receipt/ production of copy of this order and if the trial court fails to conclude the trial of the petitioner within the above stated period due to latches of the prosecution, the petitioner may renew his prayer for bail before the learned trial court itself.
