JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-09-2021 As prayed for, let the learned counsel appearing for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 24.08.2021, within four weeks of starting of Court proceeding in physical mode in normal course. Heard learned counsel appearing on behalf of petitioner and learned A.P.P. appearing for the State through video conferencing.

This application is filed for modification of order dated 09.09.2019 passed in Criminal Miscellaneous No. 24705 of 2019.

Learned counsel appearing on behalf of the petitioner submits that petitioner has been granted pre-arrest

Patna High Court CR. MISC. No.48924 of 2021(2) dt.15-09-2021 2/2 bail on 09.09.2019 passed in Criminal Miscellaneous No. 24705 of 2019 with a direction to surrender before the court below within a period of six weeks on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua, in connection with Bhabua P.S. Case No. 636 of 2018, but, due to some unavoidable circumstances, petitioner could not surrender before the Court below within the stipulated time.

In such view of the matter, let the time to surrender of the petitioner, as ordered on 09.09.2019 passed in Criminal Miscellaneous No. 24705 of 2019, be further extended by four weeks from today.

Accordingly, the modification application is allowed and the order dated 09.09.2019 passed in Criminal Miscellaneous No. 24705 of 2019 is modified to the above extent.

This application stands disposed of.
