Petitioner is an accused in a case registered for the offence punishable under Sections 307, 302/34 and other allied sections of the Indian Penal Code on the allegation that she and other accused persons entered into the house of the deceased, took away articles and assaulted her causing her death in course of treatment. Petitioner pulled the hair of the deceased in course of assault.

Learned counsel for the petitioner submits that the allegation assistant the petitioner is general and omnibus in nature. Petitioner has got no criminal antecedent. Petitioner is in custody since 1.6.2018 and several similarly situated coaccused have already been allowed anticipatory bail by a bench of this Court vide order dated 1.8.2019, passed in Cr.Mis.No.

Learned counsel for the informant vehemently opposes the prayer for bail.

In view of the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, mentioned above, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Gopalganj in Gopalganj Police Station Case No. 133 of 2019 on the condition that the petitioner shall fully co-operate with the investigation and trial of the case, failing which the Court below shall be at liberty to cancel the bail bond of the petitioner.
