This application for anticipatory bail arises out of Mansi P.S. Case No.183 of 2017 (G.R. No. 2309/2017), disclosing offences under Sections 147, 149, 353, 435, 427, 354, 307, 504 of the Indian Penal Code.
From the First Information Report, it transpires that there is allegation that 27 named accused persons and nearly 200 other persons were raising protest condemning the death of someone in an accident caused by a police jeep. The Officer Incharge of the police station is the informant. According to him, all the accused persons destroyed public property and assaulted the police personnel.
However from the First Information Report, it appears
Patna High Court Cr.Misc. No.72904 of 2018(2) dt.18-12-2018 2/2 that the allegation is general and omnibus and there is no allegation of specific overt act against this petitioner, this application is allowed.
Let the petitioner above named in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Khagaria in Mansi P.S. Case No.183 of 2017( G.R. No. 2309/2017), subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
