The petitioners apprehend their arrest in connection with Barahiya P.S. Case No.289 of 2021, registered for the offences punishable under Sections 366 and 34 of the Indian Penal Code.
Co-accused, Satyam Kumar is said to have kidnapped
Patna High Court CR. MISC. No.28820 of 2022(3) dt.22-09-2022 2/3 the daughter of the informant. The petitioners are father and mother of Satyam Kumar and the allegation against the petitioners is that they are also involved in kidnapping of daughter of the informant.
Learned counsel for the petitioners submits that the petitioners are innocent and have falsely been implicated in the present case. It is submitted that the petitioners have got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that the petitioners are father and mother of co-accused, Satyam Kumar. It is submitted that there is general and omnibus allegation against the petitioners. Learned counsel for the petitioners further submits that the victim girl has not supported the prosecution case in her statement recorded under Section 164 of the Code of Criminal Procedure.
Learned APP for the State opposed the prayer for anticipatory bail of the petitioners.
Taking into consideration the facts aforesaid, let petitioners, above named, in the event of their arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bonds of Rs.25,000/- (rupees twenty five thousand) each with two
