====================================================== CORAM: HONOURABLE MR. JUSTICE ARVIND SRIVASTAVA ORAL ORDER 18-12-2018 Heard learned counsels for the petitioner and the State.

Petitioner apprehends his arrest in connection with Kateya P.S. case No. 194 of 2018 registered for the offence punishable under section 366-A/34 of the Indian Penal Code. Learned counsel appearing for the petitioner submits that petitioner has falsely been implicated in this case at the instance of the informant. As a matter of fact, the victim girl namely Kanti Kumari in her statement under section 164 Cr.P.C. (Annexure-2) has not stated anything against this petitioner. Doctor has opined the age of the victim girl is 18 to 19 years as is evident from annexure -3. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case

Patna High Court Cr.Misc. No.73980 of 2018(2) dt.18-12-2018 2/2 and the submissions advanced on behalf of the parties, let the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XV, Gopalganj in connection with Kateya P.S. Case No. 194 of 2018 corresponding to G.R. No. 2655 of 2018 subject to the conditions laid down under section 438(2) Cr.P.C.
