JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-05-2019 The petitioners seek regular bail in connection with Mojahidpur (Babarganj) P.S. Case No. 59/2019, registered for offences punishable under Section 30(a) of the Bihar Prohibition and Excie (Amendment) Act, 2016.

Allegation is of recovery of 51 litres of foreign liquor from the bags kept by the petitioners and others. It has been submitted on behalf of the petitioners is that they have no criminal antecedent and have falsely been implicated in this case and in fact nothing has been recovered in this case and now chargesheet has been submitted and there is

Patna High Court CR. MISC. No.30460 of 2019(3) dt.23-05-2019 2/2 no chance of tampering with the evidence.

Having heard both sides, in view of the above facts, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned 02nd Additional District & Sessions Judge-cum-Special Judge, Excise, Bhagalpur, in connection with Mojahidpur (Babarganj) P.S. Case No. 59/2019, subject to the condition that petitioners will cooperate in disposal of trial and make themselves available as and when required by the court below, failing which, the prosecution shall move for cancellation of their bail bonds.
