The petitioners apprehend their arrest in Barabar Prayatan P.S. case No. 13 of 2018 registered under Section 307 and other Sections of the IPC.

The informant alleged that while he was going towards road from his house all the three petitioners surrounded him and began to abuse. They all assaulted the informant with fists and slaps. Shashi Bhushan Paswan, petitioner No.2, assaulted the informant with Lathi on his head causing blood oozing injury.

The learned counsel for the petitioners submits that there is counter version being SC/ST P.S. case No. 15 of 2018. Nidhi Kumar, the informant, daughter of petitioner No.2, lodged the case against Jitendra Yadav, informant of the present case, alleging that while she was going to take tuition Jitendra Yadav

Patna High Court CR. MISC. No.30687 of 2019(2) dt.09-05-2019 2/2 caught her hand with bad intention. When the matter was reported to his parents they also defended him. She further alleged that Jitendra Yadav and others stalked her. It is submitted that Jitendra Yadav got one lacerated wound which is superficial and simple in nature.

Considering the facts aforesaid and nature of allegation made against the petitioners, the petitioners, above named, in the event of their arrest/ surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order are directed to be enlarged on bail on their furnishing bail bond of Rs. 10,000/- (rupees ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Umesh Prasad, learned Judicial Magistrate, 1st class, Jehanabad in connection with Barabar Prayatan P.S. case No. 13 of 2018, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
