The petitioner filed this criminal miscellaneous for modification of order dated 19.07.2018 and extension of period of his surrender in pursuance of the aforesaid order passed in Cr. Misc. No.42287 of 2018. The petitioner and two others were granted anticipatory bail with a direction to the petitioner to surrender in the court below within four weeks from the date of receipt of this order but the petitioner could not surrender within the stipulated period as he has gone to Coimbatore to earn his livelihood.

Learned counsel for the petitioner submits that petitioner filed this petition on 31.10.2018 only about after three

Patna High Court Cr.Misc. No.70414 of 2018(2) dt.20-02-2019 2/2 months for modification of the aforesaid order. Accordingly, modification petition is allowed. The period of surrender is extended for four weeks from today. Let this order be read as part of the order dated 19.07.2018 passed in Cr. Misc. No.42287 of 2018.
