The petitioner is apprehending his arrest in connection with Muffasil P.S.Case nO.740 of 2018 , registered for offences punishable under Sections 147, 148, 149, 323, 307, 447, 504 and 302 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution story is that the accused persons including the petitioner came variously armed, abused the informant and there is specific allegation against one Govind Sahni that he fired, causing injury to Ganga Sahni and later on he succumbed to the injuries.

Submission of the learned counsel for the petitioner is

Patna High Court CR. MISC. No.32412 of 2019(2) dt.16-05-2019 2/2 that though he is named in the FIR but no specific allegation has been attributed against him and the specific allegation is against Govind Sahni and further submission is that the petitioner has no criminal antecedent.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Motihari, East Champaran in connection with Muffasil P.S.Case No.740 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure.
