The petitioner is apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 406 and 420 of the IPC. The prosecution case as per the complaint of Baban Bind is to the effect that the petitioner persuaded the complainant to make investment in a non-banking company, namely, Mega Mould India Pvt. Ltd. on assurance that on deposit of Rs.200/- per day, Rs.80280/- would be returned. After a year, it is alleged that the complainant deposited Rs.200/- per

Patna High Court Cr.Misc. No.72202 of 2018(2) dt.20-12-2018 2/3 day - total Rs.77200/- but the petitioner gave receipt for seven months only. The complainant made deposits in the name of son and wife.

It is submitted by learned counsel for the petitioner that the complainant deposited only for seven months, hence, failed to deposit money as per scheme for one year, which was the minimum period for getting the maturity amount. It is further submitted that the complainant failed to deposit for the full term, yet, in order to get the final maturity amount, the present complaint has been filed as a pressurizing tactics.

Considering the nature of accusation and the statement in paragraph 3 of the petition that the petitioner is not having any criminal antecedent, let the petitioner above named be released on anticipatory bail in the event of arrest or surrender within 12 weeks on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM- I, Kaimur at Bhabua in connection with Complaint Case No. 99 of 2017 subject to the conditions laid down in Section 438(2)
