This application for anticipatory bail arises out of Manjhi P.S. Case No. 230 of 2018, disclosing offences under Sections 413 and 414 of the Indian Penal Code.

A Hero Honda Splendor Motorcycle was recovered from the house of the petitioner, in respect of which, no document could be produced when demanded by the Police. It is the case of the petitioner that the house from where the recovery has been made, is possessed by joint family, consisting of several members. He has also been argued that it is not the case of the prosecution that the Motorcycle is stolen, therefore, no offence under Section 414 of the Indian Penal Code is made out. The petitioner has no criminal antecedent as stated in the application.

Patna High Court Cr.Misc. No.73087 of 2018(2) dt.19-12-2018 2/2 Considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest/surrender within six weeks from today in the Court below, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand), with two sureties of the like amount each, to the satisfaction of learned A.C.J.M.-II, Chapra, Saran, in Manjhi P.S. Case No. 230 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present himself before Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
