JUSTICE ARUN KUMAR JHA ORAL JUDGMENT (Per: HONOURABLE MR. JUSTICE P. B. BAJANTHRI) Date : 18-04-2023 In the instant petition, petitioner has prayed for following reliefs:- "i. To issue an appropriate writ preferably in the nature of certiorari for setting aside the Letter No. 1602, dated 28.12.2016, issued by the Executive Engineer, Bihar Police Building Construction Corporation, Magadh Division, Camp-Dehri-on-Sone whereby and where under the agreement No. 73 F 02/ 2010 - 11 entered into between the Petitioner and

2/4 Respondent authorities has been rescinded and the amount of advance along with security deposit made by the petitioner to the tune of Rs. 7,81,131/- (Rs. Seven Lacs Eighty One Thousand One Hundred Thirty One Only) has been forfeited.

ii. To issue an appropriate writ preferably in the nature of mandamus commanding upon the respondent authorities to allow the petitioner to complete the construction work in terms of the Agreement No. 73 F02/2010-11 within reasonable period after handing over vacant premises of the construction site to the petitioner, and iii. To grant any other relief(s), for which the petitioner may be found entitled to in the peculate facts and circumstances of the Case."

इसकारारलिय कहा पत्रत्रांक 1139 बदनत्रांक 09.09.2016 महाशर, उपरसोक्त बवषयक प्रहासमंबगक पत्र कमे समंबिमंध रमें कहनहा हक

3/4 बक उक्त कहायर्स कहा बदनत्रांक 26.09.2016 कसो अमंबतर रहापर कर बतबथ बनधर्माबरत कर गई थर बजिसकर सूचनहा आपकसो प्रहासमंबगक पत्र कमे रहाध्यर समे दर गई थर। उक्त बतबथ कसो आप कहायर्स स्थलि पर उपबस्थत नहहीं हपुए एवमं कसोई भर सूचनहा इस कहायर्मालिय कसो नहर बदयहा गयहा। तत्पशहात् उक्त बतबथ कसो सहहायक अबभयमंतहा एवमं कनरय अबभयमंतहा दहारहा कहायर्स कहा अमंबतर रहापर लिमे बलियहा गयहा। आपकहा एकरहारनहारहा समंख्यहा- 73 एफ02 2010-11 कसो बरसहाईन (Rescine) बकयहा जिहातहा हक एवमं उक्त कहायर्स रमें जिरहा अगधन एवमं जिरहानत कर रहाबशि एवमं बवपत्र समे कहाटर गई रहाबशि कसो जिब्त बकयहा जाताहै।जोसनमनप्रकहार हक1.अगधन कर रहाबशि : र. 140000/- (एन०एस०सी०) 2.शिमेष प्रबतभसूबत कर रहाबशि : र. 202000/- (एम०एस०सी०) 3.ज्रहानत कर रहाबशि : र. 281896/- 4.सरयवृबद्धि :

3. Impugned action is without there being specific notice followed by reply from the petitioner. The same are not forthcoming. Moreover, impugned action is a non-speaking order. On this count, petitioner has made out a case. Hence, the impugned action dated 28.12.2016 stands set aside.

4. Accordingly, the present petition stands allowed reserving liberty to the concerned respondent to take appropriate action after due notice to the petitioner and submission of his

4/4 reply, if any and thereafter, pass a speaking order after due consideration of reply, if any to be submitted by petitioner.
