The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 304(B)/34 of the Indian Penal Code.

The accusation is of killing the sister of the informant for non-fulfillment of dowry demand. It is submitted by learned counsel for the petitioner that petitioner is the unfortunate husband of the deceased. The allegation against the petitioner is false and concocted. In fact, the deceased was a patient and this fact was concealed. The condition of the

Patna High Court CR. MISC. No.33934 of 2022(2) dt.24-11-2022 2/2 deceased gradually deteriorated and subsequently she could not survive. The informant, after realizing the fact has voluntarily appeared before learned Court below and admitted that he had been misled by some people to believe that his sister had been killed.

Considering the fact that petitioner is husband of the deceased and within one year of marriage, the victim died, this Court is not inclined to grant privilege of anticipatory bail to the petitioner.

The prayer for grant of anticipatory bail to the petitioner stands rejected.
