JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-12-2018 The petitioners seek bail in anticipation of their arrest in connection with Makhdumpur P.S. Case No. 247 of 2018 dated 14.07.2018 instituted for the offences under Sections 147, 148, 149, 323, 324, 325, 326, 307, 452, 427, 504 of the Indian Penal Code.

Though the petitioners are alleged to have assaulted the informant and others but the injuries suffered by them are stated to be simple in nature.

The learned counsel for the petitioners has submitted that the present case has been lodged for oblique purposes. In fact, the wife of petitioner No. 4 had earlier

Patna High Court Cr.Misc. No.72769 of 2018(2) dt.21-12-2018 2/2 filed a case against the informant and others under Sections 354 of the Indian Penal Code and the present case is only counter blast of the aforesaid case.

Regard being had to the aforesaid facts as also taking into account that petitioners do not have any criminal antecedents, the petitioners, above named, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/-(ten thousands) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Jehanabad in connection with Makhdumpur P.S. Case No. 247 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Shageer/- U T
