2. The petitioner apprehends his arrest in a case registered under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, two accused persons were apprehended on the spot with 20 litres country made liquor kept in a sack and petitioner is alleged to have fled away.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on the basis of confessional statement of apprehended accused persons. Nothing has been recovered from conscious possession of the petitioner. Except disclosure statement, nothing material is against the petitioner. Petitioner has three

5. Learned A.P.P. for the State opposes the prayer for anticipatory bail.

6. Considering the facts and circumstances of the case, submissions of learned counsel for the parties and the fact that the name of petitioner surfaced in the confessional statement of apprehended accused persons, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Court of Excise, Patna City, Patna in connection with Bahadurpur P.S. Case No. 125 of 2026, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
