====================================================== CORAM: HONOURABLE MR. JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 14-01-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks bail in Sugauli Rail P.S. Case No. 23 of 2012 dated 16.10.2012 instituted under Sections 363/365/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that she has not been named in the F.I.R. and the only allegation against her is on the basis of her so called recorded confessional statement in which also she has only stated that the abducted boy was brought by her husband at Delhi and upon her protest, he was

Patna High Court Cr.Misc. No.39266 of 2014 (4) dt.14-01-2015 2/2 taken away to some other place. It is submitted that the petitioner, besides being a lady, having clean antecedent is in custody since 24.04.2014.

Learned A.P.P., upon going through the case diary, does not dispute the aforesaid position.

Considering the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in Sugauli Rail P.S. Case No. 23 of 2012. The petitioner shall cooperate in the trial and be present before the Court on each and every date. Failure to cooperate or appear on two consecutive dates, without sufficient cause, shall lead to cancellation of her bail bonds.
