2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 489(A), 489(B), 489(C) and 120B of the Indian Penal Code.
3. As per the prosecution case, in brief is that coaccused Arjun Vasfor who was apprehended with fake currency disclosed that on the instruction of this petitioner and other coaccused Suraj Bhai, who resides near Asansol railway station and he had got these counterfeit notes for giving a party in Jhajha.
4. It is submitted that no fake currency has been recovered from the possession of petitioner. He has been made
Patna High Court CR. MISC. No.33581 of 2023(2) dt.25-07-2023 2/2 accused in this case on the confessional statement of co-accused Arjun Vasfor who was apprehended on spot with fake currency. Similarly situated co-accused persons have already granted bail by this Court vide order dated 19.04.2023 in Cr. Misc. No. 34559 of 2022 . Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Railway Judicial Magistrate, Kiul, Lakhisarai in connection with Rail Jhajha P.S. case no 46 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
