JUSTICE VIKASH JAIN ORAL JUDGMENT Date: 31-10-2018 The present writ petition has been filed for a direction to the respondents to pay to the petitioner the sum assured together with other benefits earned and admissible under the terms and conditions of the Insurance Policy dated 15.12.1998 bearing no. 520820962, (Table and term No. 106/15 "Jeevan Surabhi' P.P.T. 12) of her Late husband Nitya Nand Singh, besides interest thereon, for payment being unduly delayed.
2. At the very outset, learned counsel for the respondents invites reference to paragraph-6 to the counter affidavit stating that the respondents are ready and willing to consider and
Patna High Court CWJC No.14688 of 2015 dt.31-10-2018 2/2 settle the claim of the petitioner, subject to the petitioner furnishing the requisite documents such as; final police report and death certificate of the deceased, in absence of which the claim could not be processed.
3. Having regard to the nature of the grievance, the writ petition stands disposed of granting liberty to the petitioner to approach the Branch Manager, L.I.C. (respondent no.3) with an appropriate representation along with requisite documents within a period of twelve weeks from the date of receipt/production of a copy of the judgment. If any such representation is filed together with the final police report and death certificate, the same shall be considered and disposed of expeditiously in accordance with law.
