None ====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 04-12-2018 Heard Sri Prakash Chandra, learned counsel for the petitioner. None appeared on behalf of the State . The sole petitioner apprehending his arrest in connection with Hajipur Sadar P.S. Case No. 319 of 2018 registered for the offence under Section 392 of the Indian Penal Code 1860 has prayed for grant of bail in the event of his arrest or surrender.
Learned counsel for the petitioner while pressing the present petition submits that it is true that petitioner was one of the named accused in the F.I.R. but no specific overt act has been alleged against the petitioner. He has also argued that none of the independent witnesses have supported the prosecution case. On aforesaid grounds a prayer has been for extending the privilege of anticipatory bail.
Patna High Court Cr.Misc. No.71925 of 2018(2) dt.04-12-2018 2/2 Fact remains that in the F.I.R. there is specific accusation that three accused intercepted motorcycle of the informant and bag containing currency and other articles were forcibly taken by the accused persons and they fled away. The informant identified all the miscreants including the petitioner. There is no reason to pass favourable order. The prayer for grant of anticipatory bail stands dismissed.
