The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 420, 120B and 34 of the Indian Penal Code and Section 47 (a) of the Excise Act.
Submission is that nothing incriminating was recovered from the possession of the petitioner and petitioner's name has been disclosed by the co-accused. The case was registered under the provisions of Bihar Prohibition and Excise Act.
In the facts and circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of six weeks from the

No.36365 of 2019(2) dt.11-06-2019 2/2 date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Excise Court of Shekhpura cum ADJ-II, Shekhpura in connection with Excise Case No. 490 of 2017 arising out of Ariyari (Kasar) Police Station Case No. 170 of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
