JUSTICE SANJAY PRIYA ORAL JUDGMENT Date: 07-09-2018 Petitioner is aggrieved by order dated 18.09.2015 passed by the Additional Sessions Judge, 2nd, Vaishali at Hajipur, in B.P. No.693 of 2015 arising out of Bhagwanpur P.S. Case No.106 of 2015 by which the Court below has refused to extend the privilege of provisional bail to the Petitioner.
Counsel for the Petitioner submits that one time settlement has taken place between the parties. Counsel for the Opposite Party No.2 is present. He submits that there is no information to him about one time settlement.
This Court finds that impugned order is dated
Patna High Court Cr.Misc. No.1106 of 2016 dt.07-09-2018 2/2 18.09.2015 and no any coercive step has been taken against the Petitioner because of interim protection given by this Court on 22.05.2017.
This Court on perusal of the impugned order finds that Petitioner has not fully complied the direction given by the Court below by order dated 11.08.2015. Thereafter, Court below has refused to extend the provisional bail of the Petitioner. In view of such, this Court does not find any illegality in the impugned order.
This application is, accordingly, dismissed.
The Court below will proceed with the case in accordance with law.
Interim protection given to the Petitioner by order dated 22.05.2017 is hereby vacated.
