The application for anticipatory bail arises out of Baisi P.S. Case No. 240 of 2018, disclosing the offence under Section 7 of the Essential Commodities Act. From the FIR, it appears that the Block Supply Officer, on the basis of a secret information, had conducted raid leading to recovery of 13 bags of rice. There was no claimant of the said rise, even after two days. Based on suspicion that the petitioners and other co -accused persons might have been involved in the black-marketing, the FIR came to be registered. Considering the nature of allegation made in the FIR, a case for grant of anticipatory bail is made out. This application is accordingly allowed. Let the petitioners above named, in the
Patna High Court Cr.Misc. No.73181 of 2018(2) dt.20-12-2018 2/2 event of their arrest/surrender within six weeks from today in the court below, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each, with two sureties of the like amount each, to the satisfaction of the learned SDJM, Purnea in Baisi P.S.Case No. 240 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioners shall present themselves before the Police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bonds shall be liable to be cancelled.
