The petitioner is apprehending his arrest in connection with Gogri (Paura) P.S.Case No.172 of 2018 registered for offences punishable under Sections 341, 323, 384, 385, 379, 504, 506/34 of the Indian Penal Code and Section 27 of the Arms Act.

Allegation against the petitioner and other accused persons is that in the night they came and made firing as well as took away 3 mound of fishes from his pond and it further appears that he is accused in two other cases - one of them is of similar type.

Submission of the learned counsel for the petitioner is that there is no specific allegation attributed against him and in another case he is on bail.

Patna High Court Cr.Misc. No.76592 of 2018(2) dt.31-01-2019 2/2 Heard learned A.P.P. also.

Having heard both sides and in view of allegation as well as criminal antecedent of of the facts and circumstances, as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court.

With the aforesaid observation, this application is dismissed.
