====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-02-2021 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks bail in connection with Buxar (Muffasil) P.S. Case No. 361 of 2019, registered under Section 304(B)/34 of the Indian Penal Code.

The accusation is of killing of sister of informant by her husband and in-laws due to non-fulfillment of demand of dowry.

Learned counsel appearing for the petitioner submits that the petitioner is husband of deceased and due to wedlock of petitioner and deceased, there are two female issues. Further submission is that, in fact, the deceased, wife of petitioner, was of short temperament and she committed suicide due to petty dispute occurred in the family and

Patna High Court CR. MISC. No.31707 of 2020(5) dt.22-02-2021 2/2 regarding which the information was given to the informant, but with ulterior motive, informant, brother of deceased lodged the present case. Further submission is that in course of trial of petitioner through Sessions Trial No. 76 of 2020, informant Gautam Kumar Rajbhar, Radhyshyam Rajbhar and Sumeshwari Devi @ Sumitra Devi, who are brother, father and mother, respectively, of the deceased have been examined, but they have not stated, in their evidence, about demand of dowry and harassment of deceased for same and it has also come that deceased was of short temperament and she committed suicide on petty matters. The petitioner is in custody since 25.11.2019.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Buxar in connection with Buxar (Muffasil) P.S. Case No. 361 of 2019.
