2. The petitioner apprehends his arrest in connection with Complaint Case No. 1213 of 2022, registered for the offences punishable under Section 498(A) of the IPC.

3. It is a case of matrimonial dispute. To explore the possibility of amicable settlement between the parties, the matter was referred to Patna High Court Mediation and Reconciliation Centre.

4. The parties agreed to dissolve their disputes on the following terms and conditions:-

That after great persuasion both the parties agreed to live separately and for this the Petitioner (Bhim Chaudhary) offered to pay Rs.3,07,000/-(Rupees Three Lakhs Seven Thousand Only) as full and final one time settlement amount to the Opposite Party No.2 (Arti Devi). Opposite Party No.2 accepted the offer and gave her consent.

2. That accordingly the petitioner has already paid aforesaid amount of Rs. 3,07,000/-(Rupees Three Lakhs Seven Thousand Only) to the Opposite Party No.2.

3. That both the parties have agreed to file the mutual divorce petition in terms of Section 13 (B) of the Hindu Marriage Act, before the Principal Judge, Family Court, Sasaram at Rohtas on or before 15th December, 2025 and thereafter both parties are free to lead their life as per their own free will.

4. That both the parties agreed to take steps for withdraw of respective cases Civil/Criminal (Including Rohtas Complaint Case No.1213 of 2022) filed against each other, within three months from today i.e. 01.11.2025.

5. This settlement shall be full and final settlement and no party shall claim in future against each other, in any manner, whatsoever.

6. That the above contents of the agreement have been read over and explained to us in Hindi which are have fully understood and accepted

7. That in the above terms and conditions the present settlement has been arrived at between the parties and both parties have signed in presence of their learned counsels, who have also put their signature on this agreement."

5. Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Rohtas at Sasaram in connection with Complaint Case No. 1213 of 2022, subject to the conditions as laid down under Section 438(2) Cr.P.C.

6. If either of the parties retracts from the terms and conditions of compromise, the learned court below may pass appropriate orders.
