JUSTICE DINESH KUMAR SINGH ORAL ORDER 20-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 8.2.2014 in a case registered for the offences punishable under Sections 147,148,149,326,302 and 379 of the Indian Penal Code and section 27 of the Arms Act.

It is alleged that the brother of the informant was coming from Begusarai on Yamaha motorcycle when the FIR named accused persons including the petitioner and three unknown made indiscriminate firing killing him on the spot. It is submitted by the learned counsel for the petitioner that the accusation is omnibus and general and there is no eye witness to the occurrence. It is further submitted that only family

Patna High Court Cr.Misc. No.40713 of 2014 (3) dt.20-01-2015 2/2 members have deposed against the accused persons. Co accused Deepak with similar accusation has been granted bail vide Cr. Misc. No. 36151 of 2014.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Begusarai in connection with Begusarai Mufassil P.S. Case No. 26 of 2014.

Considering the criminal antecedent of the petitioner, the learned court below shall be at liberty to cancel the bail bonds of the petitioner in case the petitioner gets involved in serious offence or defaults without any reasonable cause on two consecutive occasions.
