Learned counsel for the petitioner submits that he has not opposed the use of land for public road but he is entitled to compensation of use of his personal Raiyati land. Considering the aforesaid, the writ petition is disposed of with direction to the District Magistrate, Patna to cause an enquiry and if it is found that 2.9 decimal of the land of the petitioner was used by the authorities for making construction of road, he shall see that the petitioner be appropriately compensated by payment of compensation for use of the said
Patna High Court CWJC No.18602 of 2017(3) dt.22-04-2019 2/2 land.
Necessary decision in the matter of determination of the private land of the petitioner and payment of compensation by the District Magistrate shall be made within a maximum period of sixty days from the date of general election is over.
