The petitioner seeks bail in a case registered under Sections 399, 402 of the Indian Penal Code and Sections 25(1B)A, 26, 35 of the Arms Act. Allegation is that one loaded country made pistol along with two live cartridges is recovered.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 14.09.2018. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. No incriminating article has been recovered from the possession of the petitioner. Name of the petitioner has come on disclosure made by coaccused.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XIII, Patna in connection with Ram Krishna Nagar P.S. case No.368 of 2018.
