The petitioner seeks bail in connection with Barahara P.S. Case No. 72 of 2023 dated 08.02.2023 registered for the offence punishable under Sections 414/34 of the Indian Penal Code.

The allegation against the petitioner is that one stolen motorcycle has been recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner was not sitting on the alleged motorcycle and there is

He further submits that the petitioner is in jail custody since 09.02.2023 and charge sheet has already been submitted although he has two criminal antecedents but he is on bail on those cases. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.

Considering the aforesaid facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur, Ara in connection with Barahara P.S. Case No. 72 of 2023, subject to the following conditions:- (i) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court. (ii) In case of absence on two consecutive dates without sufficient reason or if the petitioner misuse the liberty or violate any of the conditions imposed upon him his bail bond will be liable to be cancelled by the Court concerned.
