JUSTICE ASHUTOSH KUMAR ORAL ORDER 20-12-2018 The petitioners seek bail in anticipation of their arrest in connection with Laxmipur P.S. Case No. 317 of 2018, dated 18.08.2018, instituted for the offences under Sections 143, 323, 308 and 504/34 of the Indian Penal Code.
The informant has alleged that the petitioners were throwing/dumping mud in her field and on protest, she and others were assaulted.
The learned counsel for the petitioners has submitted that there is a counter version of the occurrence as well in which one Khana Yadav has been seriously injured.
Patna High Court Cr.Misc. No.72596 of 2018(2) dt.20-12-2018 2/2 The petitioners are persons of clean antecedents and there is nothing on record to indicate that the assault perpetuated by the petitioners has resulted in any grievous injury to anybody. The allegations are also general and omnibus in nature and nobody in particular has been specifically attributed with any specific act of assault.
Considering the aforesaid facts as also taking into account the clean antecedents of the petitioners above named, they, in the event of their arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, are directed to be released on bail on their furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui, in connection with Laxmipur P.S. Case No. 317 of 2018, subject to the conditions laid down under Section 438(2) of the Cr.P.C. (Ashutosh Kumar, J) Praveen-II/- U T
